What is a Design Patent?

A design patent is one which protects either an ornamental design, improved decorative appearance, or shape of an invention, i.e. most appropriate if a product already in use is improved not in function but in aesthetics.  A good example is the granted design patent for Apple for its iPod mp3 player in 2004.  A patent was issued solely for the ornamental design of the mp3 player.
